Terms + ConditionS

1. Photography Package Details: “Solo Family Session”

  • a. One hour family portrait session on a date and location agreed upon by both parties. 

  • b. Online gallery of edited images for viewing and print purchasing (up to 30x40in). Digital files may be downloaded by Client, sized at 8x12in.

2. Fees. As agreed upon by the Clients, the total non-refundable service fee of $650 is to be paid to Photographer upon booking. Photographer will reserve the date agreed upon and will not make another reservation for that time. Should a scheduling or weather conflict arise, date may be transferred to a similar time that is available for both Client and Photographer.

3. Photo Delivery. Client will receive a Photographer’s selection of images via the online gallery within 3 weeks after the session date.

4. Copyright, Ownership, Use, and Accessibility of Images.

  • a. Ownership. Photographer retains ownership of all Copyrights to images. Clients are granted a perpetual, limited use license to edited JPG images downloaded via the online gallery. Commercial or third party reproduction without Photographer’s consent is prohibited.

  • b. Online sharing. Images shared by Client via web or social platform shall list credit for Joe and Jen Photo via tag, caption, or other similar notification. Images may not be modified, edited, or filtered in any way.

  • c. Technology. Clients acknowledge that digital file technology is subject to unpredictable change. Files may be replaced in case of loss, failure to save, or upgrades in technology in accordance with photographer file pricing at that future time. 

5. Model Release. Clients agree that Photographer may use images for portfolio, advertising, website, and other means of promotion of Photographer. Clients waive right to payment, royalties, or any other consideration for the use of images. Clients waive the right to inspect or approve the finished product wherein their likeness appears. Photographer is hereby held harmless and released from demands and legal claims which Clients, their heirs, representatives, or any other persons acting on Clients’ behalf may have by reason of this authorization.

6. Artistic Style. Clients agree that they are familiar with Photographer’s current portfolio and are requesting services with knowledge of the artistic style. Clients acknowledge that this style may evolve, and that photographs delivered in the future may differ from those taken in the past. Clients acknowledge that delivered photos shall not be subject to rejection based on aesthetic criteria.

7. Limit of Liability. In the unlikely event of an equipment failure, professional back-up equipment will be on hand. In the rare case that photographs are lost, stolen, or destroyed for reasons within or beyond Photographer’s control, liability is limited to return of the session fee. Limit of liability for partial loss of photos shall be prorated based on percentage of compromised images of total.

8. Insurance: Joe and Jen Photo carries General Liability Insurance and Professional Liability Insurance, and will do so through the scheduled session date. This protects persons involved in the session, the equipment of the Photographer, and the copyright protection of Photographer.
